Welcome to Banbury Property Management (“BPM,” “we,” “our,” or “us”). By accessing or using our website (banburypropertymanagement.co.uk) or our services, you agree to comply with and be bound by the following Terms of Service.
1. Services Provided
BPM provides property management services for landlords, leaseholders, and investors. Specific services include rent collection, tenant communication, inspections, compliance reporting, maintenance coordination, and related property management activities.
2. Eligibility
By using our services, you confirm that you are at least 18 years old and legally capable of entering into contracts.
3. Fees and Payment
Fees for our services will be agreed upon in writing before work commences. Unless otherwise stated, fees are expressed as a percentage of rental income or as fixed annual charges for micro-assets (e.g., garages). All fees must be paid in accordance with agreed terms.
4. Responsibilities of Clients
Clients must:
Provide accurate and complete information about their property.
Ensure that BPM has appropriate authority to act on their behalf.
Notify BPM of any changes to ownership, tenancy, or lease terms.
5. Limitation of Liability
While BPM acts with care and professionalism, we are not liable for:
Losses arising from tenant default, market conditions, or unforeseen property issues.
Any delays caused by contractors, third parties, or legal proceedings beyond our control.
Our liability to you shall not exceed the total fees paid by you to BPM in the 12 months prior to a claim.
6. Termination
Clients may terminate their management agreement with 30 days’ written notice, unless otherwise agreed. BPM also reserves the right to terminate services with notice if fees are unpaid or instructions are unreasonable.
7. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
